1. Definitions: The "Software" refers to the entirety of the program, including the executable for any version of the program and all files that come bundled with any version of the program. The term "Online Services" refers to any and all features and functionality that may be accessed from within the Software, even under circumstances when the features and functionality are not being accessed from the Software directly. An "Online Account" refers to an account by which one may make use of Online Services. An "E-Mail Address" is a text that is provided for the destination of electronic mail, including but not limited to when such text is submitted when a person uses the program for the creation or modification of an Online Account. "Personal Information" refers to information that identifies a person and may be used to contact the person. "Non-Personal Information" refers to information other than Personal Information. "Bill Jacobs" refers to the primary author and developer of the code for the program.
2. Applicability of Terms and Conditions: The terms and conditions described herein are binding on all persons who create or use an Online Account or who make use of Online Services, as a condition of their use.
3. Usage of Personal Information: Personal Information may be collected during usage of the Online Services. This information includes, but is not limited to, E-Mail Addresses, Internet IP addresses, platforms, and play and usage statistics. The behavior of the Software, including the behavior pertaining to the presentation of advertisements, may be tailored based on this information. Personal Information collected during usage of Online Services may be viewed by Bill Jacobs and used for the purpose of directing the development or improvement of features or services in the Software or in other projects with which Bill Jacobs is involved. Bill Jacobs may authorize third-party contractors to make use of Personal Information collected during usage of Online Services to assist in directing the development or improvement of features or services in the Software or in other projects with which Bill Jacobs is involved. Bill Jacobs and third-party contractors who have access to the Personal Information will endeavor to protect the confidentiality of Personal Information collected during usage of Online Services. The usage of Personal Information beyond directing the development or improvement of features or services in the Software or in other projects with which Bill Jacobs is involved is prohibited without the consent of the user from which the Personal Information was collected.
   
   These restrictions apply exclusively to deliberate disclosure of such Personal Information. Accidental disclosure, including but not limited to that which is caused by software glitches and unauthorized access to the information by third parties, is exempted. In addition, Bill Jacobs and others involved in the production of the Software reserve the right to release any relevant Personal Information in the event of a formal complaint or legal action arising from the usage of the Software, or as is required by law.
4. Ownership of Non-Personal Information: All Non-Personal Information that is sent while using the Online Services automatically becomes the property of Bill Jacobs for the maximum duration of time permitted by law. Such information includes, but is not limited to, puzzles submitted using Online Services and the user names of the creators of these puzzles, ratings for these puzzles, and play and usage statistics for puzzles that have been submitted using Online Services. Bill Jacobs may, at his sole discretion, make use of this information for any commercial or non-commercial purposes, and he may allow others of his choosing to make use of this information for any commercial or non-commercial purposes, according to the permission he grants such persons. Bill Jacobs may grant shared or exclusive ownership of such information to persons of his choosing, according to those terms to which he agrees in writing.
5. Usage of Online Services: A person may not make use of the Online Services by any means other than by personally using the program, and by other means that are authorized by the express written permission of Bill Jacobs. Each person may create a maximum of five (5) Online Accounts. No Online Account may be given an E-Mail Address that is not owned by the creator of the Online Account. No person may use an Online Account or request the password for an Online Account unless he is the creator of the Online Account or has permission from the creator of the Online Account. The usage of Online Services by persons other than Bill Jacobs is limited to non-commercial, entertainment purposes by persons who are at least thirteen (13) years of age and to those purposes and individuals permitted by Bill Jacobs in writing. Disallowed uses include, but are not limited to, advertisement, solicitation, denial of service attacks, and attempts at unauthorized acquision of Private Information. No person may knowingly submit multiple ratings for a single puzzle using multiple Online Accounts, recognizing that such ratings may be automatically submitted without alerting the user.
6. Allowable Content: No person may submit any copyrighted content using the Online Services, unless he is the sole owner of the copyright or has the permission of the owner or owners of the copyright, as is required by law for the usage of copyrighted material. No person may sumbit content using the Online Services that is offensive, abusive, obscene, vulgar, profane, sexual in nature, or otherwise in violation of the law.
7. Responsibility of Content: Content submitted using Online Services is the sole responsibility of the person or persons who submitted the content. Bill Jacobs and others involved in the production of the Software shall not be held liable for any of the content submitted using the Online Services by other users. In particular, Bill Jacobs and those involved in the production of the Software will not be held liable for any inappropriate, illegal, or defamatory content submitted by other users.
8. Measures Permitted by Bill Jacobs: An Online Account and access to Online Services may be revoked or abridged at any time, in any manner, and for any reason, at the sole discretion of Bill Jacobs, to the extent permitted by law. Measures permitted by Bill Jacobs include, but are not limited to, the removal of Online Accounts, the denial of service to persons based on their Online Account or Internet IP address, the removal of submitted puzzles, and the removal of ratings for puzzles. Online Services may be temporarily or permanently disabled for any reason, including but not limited to modification, addition, or testing of new or existing functionality, computer failures, cost of hosting, excessive Internet traffic, and abuse of Online Services. Bill Jacobs is permitted, at his discretion, to give others authority to take the measures he is permitted to take, to the extent he deems appropriate.
